RMnoFlock: Get Flock out of Rolling Meadows

Planned 10/13 statement to the Rolling Meadows city council:

Mayor, City Council, thank you for your time and for the time you give our community.

I’d like to report a crime and request an investigation into suspected ongoing illegal activity being conducted by the city. 

Rolling Meadows allowed West Chicago police officers to search RM Flock cameras for at least 16 license plates for reasons associated with immigration at least 469 times according to Flock Logs (Appendix A). 

Whatever you think of immigration enforcement, using the cameras for this purpose is against state law. The Illinois ALPR law is very short. I’ll include it here for reference (emphasis added): 

 (625 ILCS 5/2-130)
    Sec. 2-130. User of automated license plate readers; prohibitions.
    (a) As used in this Section:
    "Automated license plate reader" or "ALPR" means an electronic device that is mounted on a law enforcement vehicle or positioned in a stationary location and that is capable of recording data on or taking a photograph of a vehicle or its license plate and comparing the collected data and photographs to existing law enforcement databases for investigative purposes. "ALPR" includes a device that is owned or operated by a person or an entity other than a law enforcement agency to the extent that data collected by the reader is shared with a law enforcement agency.
    "ALPR information" means information gathered by an ALPR or created from the analysis of data generated by an ALPR. 
    "ALPR systems" means multi-agency or vendor agreements that allow the sharing of ALPR information collected in Illinois.
    "ALPR user" means a person or entity that owns or operates an ALPR device. 
    "Law enforcement agency" means a State or local agency, unit of local government, or private entity charged with the enforcement of State, county, or municipal laws or with managing custody of detained persons in any state or jurisdiction.
    (b) An ALPR user shall not sell, share, allow access to, or transfer ALPR information to any state or local jurisdiction for the purpose of investigating or enforcing a law that:
        (1) denies or interferes with a person's right to choose or obtain reproductive health care services or any lawful health care services as defined by the Lawful Health Care Activity Act; or

        (2) permits the detention or investigation of a person based on the person's immigration status.

    (c) Any ALPR user in this State, including any law enforcement agency of this State that uses ALPR systems,shall not share ALPR information with an out-of-state law enforcement agency without first obtaining a written declaration from the out-of-state law enforcement agency that it expressly affirms that ALPR information obtained shall not be used in a manner that violates subsection (b). If a written declaration of affirmation is not executed, the law enforcement agency shall not share the ALPR information with the out-of-state law enforcement agency.
    (d) ALPR information shall be held confidentially to the fullest extent permitted by law.
    (e) Nothing in this Act shall define or limit any rights under the Reproductive Health Act.

In the past we’ve shown evidence that Rolling Meadows has allowed access to Federal Immigration agents for the purposes of Immigration enforcement. We have evidence that the city has allowed access to out of state police officers who have used it for stalking and then the internal investigations group conducting that investigation also used Flock for stalking all without the required written declaration.

This is the third time we’re providing evidence that the he city has violated the law by allowing access to its cameras. 

This establishes a pattern of three times the city has allowed illegal use, however this is not where this statement ends.

Last year Secretary of State Giannoulias disclosed that federal agents accessed Illinois Flock systems for immigration purposes. During that investigation, West Chicago police officers stopped searching Flock with reason codes associated with immigration according to Flock Logs. However, they continued searching at least 6 of the same 16 plates with generic reason codes including “Inv”, “Drug Activity” and “Missing” (Appendix B).

Changing the reason codes and continuing to search these plates is evidence of intent to conceal a crime. These officers then continued to search Rolling Meadows cameras for generic reasons such as “Inv” and Flock default drop down reason codes up to the latest logs available.

This is evidence of a potential ongoing crime that Rolling Meadows is perpetrating. You the council, may be allowing a crime to be committed knowingly.

The city has said that it is conducting audits of our logs, that it can investigate case numbers and can prevent misuse. I request the city investigate whether is West Chicago or officers from any other city continue to cause Rolling Meadows to conduct illegal activity exposing liability onto our community and our tax payers.
